GENERAL TERMS AND CONDITIONS
Article 1 Definitions
In these Terms and Conditions:
a. Debby Zagt: the sole proprietor offering coaching sessions, programs, and related services.
b. Client: any natural person who engages in, or intends to engage in, an agreement with Debby Zagt.
c. Agreement: any agreement between Debby Zagt and a Client, including coaching sessions, programs, or any other service.
d. Session: a personal coaching session conducted via Teams or Zoom, in English or Dutch.
e. Program: a series of coaching sessions or other structured offerings.
f. Website: the website operated by Debby Zagt: https://www.debbyzagt.com (or future equivalent).
Article 2 General

These Terms and Conditions apply to all Agreements in which Debby Zagt provides services to the Client, unless agreed otherwise in writing.

All content on this website—including text, images, graphics, videos, audio, and materials—is protected by copyright.
No content may be copied, shared, reproduced, or distributed without written permission from Debby Zagt. -
All names, logos, and materials used within the content are proprietary. Any unauthorized use may violate copyright, trademark, and intellectual property laws.

Submissions, comments, or suggestions sent to Debby Zagt become the property of Debby Zagt unless agreed otherwise.

In case of ambiguity, the interpretation of these Terms shall follow the intended meaning and spirit of the document.

If any provision is void or invalid, remaining provisions shall remain fully applicable.
Article 3 Guidance Process & Expectations

Guidance is a collaborative process focused on personal insight, self-awareness, and growth.
It is not a substitute for medical, psychological, or psychiatric treatment. -
Guidance is not outcome-guaranteed. The client acknowledges that their own engagement, openness, and actions influence results.

Guidance is not crisis care. Clients needing crisis intervention or mental health treatment agree to seek appropriate professional services.
Article 4 Offers

All offers and prices are non-binding.

Prices apply to the specific offer and do not automatically extend to future services.

Obvious errors (typographical or technical) are not binding.
Article 5 Conclusion of Agreement

Sessions are scheduled personally, not via an automated booking system.

After scheduling, the Agreement is considered formed.
-
Terms and Conditions are provided prior to or during scheduling.
Article 6 Structure of Sessions

Sessions take place via Teams or Zoom.
-
Sessions are conducted in English or Dutch.
-
Session duration: approximately 60 minutes.

Between-session support
-
Clients may request one short phone/video call (10–15 minutes) between sessions.
-
Clients may send text messages, but responses are not guaranteed.
-
Any additional support may require a paid session.
-

Scheduling is done by mutual agreement via email or during a session.
Article 7 Payment
-
Sessions are paid after the session, unless otherwise agreed.

Clients receive an invoice after each session.
-
Invoices must be paid within 7 days.

Payment methods:

Bank transfer
-
Bitcoin
-
The euro amount on the invoice is leading.
-
The Bitcoin equivalent reflects the euro amount at the time of billing.
-

Coaching is not covered by Dutch health insurance.
Article 8 Rescheduling and Cancellation

Sessions cancelled 48 hours or more before the appointment can be rescheduled free of charge.
-
Sessions cancelled less than 48 hours in advance will be charged in full.
-
Failure to appear without prior notice results in the session being charged.
Article 9 No Statutory Right of Withdrawal
Because appointments are scheduled personally, not booked online or prepaid through a digital system, the EU statutory “14-day right of withdrawal” for online purchases does not apply.
Article 10 Early Termination

Either party may end the coaching process at any time.

If a client chooses to end coaching, upcoming scheduled sessions must still be cancelled according to Article 8.

Sessions already completed remain payable.
Article 11 Liability

Debby Zagt is not liable for any physical, mental, emotional, or financial damage resulting from sessions or from actions taken by the client.

The client acknowledges responsibility for their own decisions, actions, and wellbeing.
-
Liability, if ever applicable, is limited to the total amount paid by the client for services.
Article 12 Confidentiality & Privacy (AVG/GDPR)

All client information is treated confidentially.

Personal data is processed according to GDPR standards.

Information will not be shared unless:
-
required by law
-
the client provides explicit written consent
-
there is serious concern about personal or public safety
-
Article 13 Intellectual Property
-
All materials created by or provided by Debby Zagt remain the property of Debby Zagt.
-
Clients may not copy, distribute, or reproduce materials without written consent.
-
Recording sessions (audio or video) is strictly prohibited unless written permission is granted.
Article 14 Force Majeure
Unexpected events such as illness, technical issues, or emergencies may require rescheduling.
A new date will be agreed upon with the client.
Article 15 Applicable Law & Disputes

All Agreements are governed by Dutch law.

In case of disputes, parties will first seek mediation.
-
If unresolved, disputes will be submitted to the competent Dutch court.
